Membership agreement
The terms and conditions of the Live Well Membership Agreement consist of these terms and conditions and any additional documents which are referred to.
Leisure Services and Facilities
You may use the leisure services and facilities described in the Live Well Membership agreement.
The Leisure Services and Facilities may vary from time to time where additional leisure services or facilities are made available, or where we withdraw Leisure Services or Facilities for any reason. Subject to your right to end this membership agreement below, we shall have no liability to you if Leisure Services and Facilities are not available.
Where the overall availability of leisure services or facilities is significantly reduced, you may end this Membership Agreement by writing to buryleisure@bury.gov.uk, quoting your membership number.
For the avoidance of doubt, the removal of any single activity or class shall not be considered a significant reduction of Leisure Services or facilities and any agreement by us to end this Membership Agreement for reasons of a significant reduction of Leisure Services or Facilities shall be in our absolute discretion.
We may end this Membership Agreement if a change in the law or regulations or Government policy means that we are not able to continue to provide any of the Leisure Services and Facilities.
Most Leisure Services and Facilities shall be available to you at no additional charge, however, special Leisure Services and Facilities (e.g. specialised training or tutoring and special activities) and any Leisure Services and Facilities not described in this agreement may be subject to an additional charge.
Membership fees
In the case of fully paid memberships, you shall pay the first year's membership fees at the time of applying for membership. This payment is non-refundable.
In the case of monthly membership paid by Direct Debit Payments, you shall pay the first month's Membership Fees at the time of applying for membership.
All subsequent payments shall be made as Direct Debit Payments deducted each month in advance. Membership Fees are due and payable even if you do not use the Leisure Services and Facilities.
Changes in fees
The Membership Fees on the application form are shown at current rates but we may vary the Membership Fees by giving you 30 days’ notice in writing of such.
If we increase the Membership Fees payable by you, you may end this Membership Agreement by giving us a minimum of 30 days’ notice in writing.
Period of membership
Your membership shall begin on the day you complete your application and pay membership fees.
You may end the Membership Agreement at any time by notifying us in writing, giving at least 30 days’ notice and quoting your membership number.

If you pay by Direct Debit, please note that following receipt of your notice of termination, your membership will terminate 30 days following the next direct debit payment.
Cancelling future Direct Debit payments without notifying us in writing will not automatically cancel your Membership Agreement and you will continue to be liable to make Direct Debit payments.
You are liable for any unpaid Membership Fees up to and including the date that your Membership Agreement terminates under this section.
You will be notified in writing that your membership has been cancelled and the exact date it will end. You may continue to use Leisure Services and Facilities until this date.
Membership card and activity bookings
You shall be issued with a membership entry device of choice, which you must look after and produce when you visit one of the leisure centres.
All activities should be booked in advance either online or through the kiosks in the centre. Entry to the centre is gained by tapping your entry device on the access readers in the centres.
Your membership is personal and not transferable so only you can use your membership entry device and activity ticket.
If you lose, destroy or damage your membership entry device, a fee shall apply for the issue of a replacement membership entry device.
Notices
Any notice you give to Bury MBC must be in writing via email and include you membership number. Write to bury.leisure@bury.gov.uk
DATA PROTECTION NOTICE - HOW WE USE YOUR INFORMATION
We will use any information you give to us to provide the Leisure Services and Facilities to you, manage your membership (including your account and any debts), carry out marketing or market research, (unless you have opted out), and on an anonymous basis for monitoring diversity and usage of the Leisure Services and Facilities.
Our right to end this agreement
We may end this Membership Agreement with immediate effect if you break any terms and conditions of this Membership Agreement, including failing to make a payment when it becomes due. You are liable for any unpaid membership fees, up to and including the date we terminate your membership agreement.
Liability
You must pay our reasonable costs and losses that arise due to you breaking this Membership Agreement.
We do not exclude or limit our liability for death or personal injury resulting from our negligence, fraud or fraudulent misrepresentation or to any extent not permitted by law.
We shall not be liable to you for any indirect losses arising out of, or in connection with this Membership Agreement, for any losses in excess of £100,000 or in respect of any loss specifically excluded by the terms of this Membership Agreement.
You remain liable for any unpaid Membership Fees on the termination of your Membership Agreement for any reason. If you do not pay these outstanding Membership Fees, we reserve the right to take such further steps as may be necessary to recover them.
What's included in my membership?
All members have the benefit of booking activities up to ten days in advance, online.
Live Well Memberships
Gym induction and use, personal programme (plus updates if required), swimming, aqua aerobics, instructor led studio classes, racquets sports, (see section on court bookings), virtual studio classes and any available fitness technology.
Swim Only Membership
Access to swimming at any Bury Leisure Facility. Does not include Aqua Aerobics classes.
Gym Only
Access to gyms at all any Bury Leisure Facility.
Junior membership
Access to gyms and swimming at any Bury Leisure facility.
Daytime membership
Gym induction and use, personal programme (plus updates if required), swimming, aqua aerobics, instructor led studio classes, racquets sports, (see section on court bookings), virtual studio classes and any available fitness technology between the hours of 6.30am and 4.30pm only, from Monday to Friday and all-day Saturday and Sunday.
Comfort and wellbeing during exercise
Suitable attire and training shoes must be worn at all times.
Drink water during your exercise session to avoid dehydration.
Water coolers are provided in or near the studios and gyms for your comfort (you will need to bring a refillable water bottle).
Gym
If you would like to use the gym facilities, you will need to attend an induction session with an instructor before being allowed to use the facilities unsupervised. This session must be pre-booked.
You will be required to accept a health commitment statement prior to commencing your induction.
If you are unsure at any time of how to use a piece of equipment, please ask a fitness instructor to show you.
Always follow your gym programme and complete a warm-up and a cool-down. If you have any queries regarding your gym programme, please speak to a gym instructor.
In the interest of hygiene please wipe down any equipment after you have used it.
Studio Classes (Castle Leisure Centre only)
A variety of studio classes are offered. Please see our studio timetable for full details of what is available.
Suitable attire and training shoes must be worn at all times (see 'comfort and wellbeing' section above).
Court Bookings (Castle Leisure Centre only)
Please note that your court time includes a changeover/set-up time.
If you do not use a pre-booked court, we will charge you a 'no show fee' which will be charged at the current full cost of the activity booked.
If you attend a court booking with up to 3 guests per court, a guest fee will be equivalent to 50% of the cost of a court. If all players are members, then no guest fee will be applied.
Use of vacant courts which have not been booked is not permitted by members or guests. Use of vacant courts by guests will incur the applicable court fees.
Racquets/ bats can be hired, a fee will be chargeable.
Fitness Classes
A variety of fitness classes are offered. Please see our studio timetable for full details of what is available.
If you do not attend a pre-booked fitness class, we will charge you a 'no show fee' which will be charged at the current full cost of the activity booked.
Class cancellations can be made online up to 1 hour before the class time.
Suitable attire and training shoes must be worn at all times (see 'comfort and wellbeing' section above).
Lockers
You should always use the lockers provided.
Please check which coin is required at the centre you wish to use.
Lockers are only to be used for the duration of your visit. Items left overnight will be removed on the following day and treated as lost property.
Behaviour
All users of the Leisure Services and Facilities shall comply with all reasonable instructions and requests made by Bury Leisure Centre staff and any additional rules or restrictions in respect of the use of or the facilities and equipment.
For the comfort of other guests mobile phones must not be used in any activity areas of the building.
Use of image recording equipment - cameras, mobile phones, camcorders etc
Bury Council requires that any recording of images in the leisure centres must be authorised by the Duty Manager.
Please ask to see our policy with regard to image recording.
Health and Safety
For reasons of health and safety we request that you update your Membership account promptly in the event of a change of emergency contact.
Please inform a member of staff if you feel unwell during your session.
In the interests of your health and safety the leisure centre Duty Officers have the right, acting reasonably, to refuse your admission to the leisure centres or restrict your use of the facilities if your presence could result in a health and safety risk to you or anybody else.
If you have any special needs, disability or any health-related problems or contagious diseases we require that you disclose this to the Council or the Duty Officer prior to use of a centre's facilities. The Council reserves the right to refuse admission to a centre's facilities to safeguard the health and safety of yourself and other users of the centre.
Please speak to a Gym Instructor before using free weights in the gym.
Food and hot drinks must not be taken into any of the activity areas in the centres.
Parking
Parking at Castle Leisure Centre and Ramsbottom Pool and Fitness Centre is subject to availability. We will not be liable to you if parking is not available for any reason.
Castle Leisure Centre
For members
All members, (excluding junior members), are eligible to take advantage of up to 2.5 hours of free parking, when using the facilities at Castle Leisure Centre.

You do not need to pay for parking at Ramsbottom Pool and Fitness Centre.
